Critical race theory was the predecessor of the civil rights movement. They both came as intellectual ways of resistance of cruel affairs. Although they have the same principles, Critical Race Theory has evolved entirely on its own. Since its origination many organizations have adopted this theory such as banks, hospitals, and most businesss.Cornell West writes that “critical race theory compels us to confront critically the most explosive issue in American civilization: the historical centrality and complicity of law in upholding white supremacy. ” This theory tries to dig deep into the more subtle forms of unconscious or conscious racism.Critical Race theory is made up of four major themes; First is the belief that race is central, not peripheral, to American thought and life. Second is the notion that racism is common and ordinary rather than rare and episodic, so that a great deal of Americans’ social life is affected by it.
First presented in the mid-1980s in American Law Schools, Critical Race Theory contends over time white supremacy and racial influence over African-Americans, institutionalizes and fosters all minorities.Critical Race Theory suggests that to combat this “institutional racism,” oppressed racial groups have both the right and the duty to decide for themselves, which laws are valid and are worth observing.
Critical race theory is an intellectual and political movement within legal studies to transform the legal academy in terms of its analysis of racial inequalities and use the law to transform society in markedly antiracist directions.
